Displaying others work, is it the same as reproducing?

Ok, we all know that you CAN NOT reproduce or sell images of another artists work, but what about displaying your collection of originals online?

I am building a nice collection, and I would like to show it off. I would like to start a page somewhere (blog, website, something) showing off pieces I own (where I purchased the original), and I know museums and galleries often do this, but what is everyone’s opinion on this.

Though I would not be selling prints if someone else’s work, it is still technically “publishing” their work to a website. Would this be in violation of the artists copyright? It would be possible for someone to “steal” the image from whatever personal gallery I set up, and I would feel awful if I caused any hurt feelings between me and another artist.

Of course, when possible I will ask the artists if they mind the piece I have being displayed online, the problem is I have a few pieces in my collection where I do not know the artist or have no way to contact them.

This also poses the question of weather someone who owns an original can reproduce that work for the purpose of selling the original? Say I have a painting that I no longer want in my collection; can I put a picture of it on a flyer listing the painting for sell. I would think the answer would be yes, as I am selling the original that I have already purchased, but technically it is a form of reproducing/distributing the image when I pass out the flyer…

Just some questions that pop in my mind when I am over thinking things… I know I’m over thinking things, just interested in others opinions…

I hear you, Joe.
There are many facets to this, although my issue is in a way the reverse of yours. When I was building my Facebook Fan page, I wanted to put examples of my graphic work there, but had second thoughts as, officialy, the work belongs to the client and/or the agency I was working for at the time.

Maybe in all cases, the answer is "ask". And the official owner of the copyright may well say yes. When you buy a piece of artwork, write something up spelling out who has what rights, with or without a time limit.

MY inital response to the question of selling other artists works is that you ought to be able to show the item that you are selling,without having to contact the artist personally...but then I don't really know.  Maybe we just have to wait for the artist to croak before we can sell off our collections of their stuff.  Seriously maybe someone knows a lawyer who specializes in this stuff. It is kind of touchy.

My initial response was sure, as long as you credit the artist. I came across someone on FB who had a lot of my work on there (she had an album of art she really liked), she wasn't claiming it was her own & I was happy for the exposure.

Re. to take a pic to sell it, I don't see why not. How are you supposed to sell artwork based on a description alone? You're not selling prints, just the artwork itself.

I don't think that you are breaking copyright when you sell what you own, many artists mail out "in good faith" agreements. Requesting that if you sell their original work, that you notify the artist who you sold it to,(some even request the selling price) so (the artist knows where thier originals are and can send a request in the event of a retro gallery show of their artwork. They also ask to be told if say you donate their art, or lend your collection to gallery or museum. This is all part of building mailing list, and clientele lists. I just write down in a separate journal, who I sell the original to and thier address. I may send out a good faith agreement when I am truly rich and famous. ROFLMAF!

As for showing others art work, I always let the artist know if I want to show their stuff, send them a link to the website and ask their permission. It is a courtesy, and a good way of sometimes getting them to "feature" your stuff. I have noticed when I favorited any work of art on imagekind, facebook immedately pops up and asks if I want to publish my favoriting and I do. So I wouldn't be too worried about it,(provide you give credit and show it in a positive light) but I would contact anyone that I could.
